PLEASE READ THIS INFORMATION CAREFULLY. THE PURPOSE OF THIS AGREEMENT IS TO SET FORTH THE DETAILS ABOUT THE ART MEDICINE GARDEN GATHERING, IN-PERSON RETREAT SO THAT YOU ARE CLEAR AS TO THE REQUIREMENTS, EXPECTATIONS, BENEFITS AND THE SUPPORT YOU CAN EXPECT TO RECEIVE.
You (“The Client/Mentee”) agree to work with Art Medicine, LLC (The Company). Company will provide (The Mentor) - Alexis Cohen. The Mentor will conduct sessions with the Client. In evidence of my dedication, You, the Client, agree to make this financial and leadership commitment to take part in this retreat.
DATE OF IN-PERSON RETREAT: June 10-13, 2025
PAYMENT: The total for the Retreat is stated on our checkout page. Payment can be made by Stripe or by credit card. You give us full permission to automatically charge your credit or debit card as payment for your Retreat for which you will receive an electronic receipt. You agree that chargebacks are not permissible, and we reserve the right to report them to the three credit bureaus or any other third-party source that affects your credit in your respective country. Missed Payment: We understand that there can be major life events or circumstances that prevent making your payments on time, or the monthly payment if paying on a payment plan, so we do allow you a 3–5-day grace period in which to make payment. However, if payment has not been received after five days, in our sole discretion, we reserve the right to stop your access to and participation in the Retreat immediately. Refund/Cancellation Policy: After booking, if you need to cancel for any reason, you'll receive a full credit toward a future Art Medicine Offering if you cancel at least four weeks before the retreat start date. If you cancel within four weeks of the retreat, you'll receive a 50% credit toward a future Art Medicine Offering. We do not offer cash refunds. We understand that life happens, and we want to offer flexibility while holding space for this special experience.

Dates: June 10-13, 2025 (We recommend arriving June 9th)

SESSIONS: If the In-Person Retreat needs to be rescheduled due to Client or Mentor illness, Client may apply their investment to another Art Medicine experience. Client is responsible for any administration fees or rebooking fees incurred by the company due to rescheduling.
SESSION DURATION: Client understands that if they are late, we will not extend the retreat duration to accommodate Client.
CLIENT (MENTEE) NOTICES:
As a Mentee, I understand and agree that I am fully responsible for my physical, mental and emotional well-being during my sessions, including my choices and decisions during and after sessions.
I understand that “mentoring” is a Professional-Client relationship I have with my mentor to facilitate the creation/development of personal, professional or business goals and execute that strategy/plan for achieving my goals.
I understand that mentoring is a comprehensive process that may involve all areas of my life, including work, finances, health, relationships, education and recreation. I acknowledge and agree that deciding how to handle these aspects of my life; even with mentoring, will remain exclusively my sovereign responsibility, and I do not hold the Mentor liable for my actions.
I understand that mentoring is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and I will not use the mentoring as a substitute for any form of diagnosis, treatment, or therapy.
Confidential Information shall not include any such information which Mentor can establish (i) was publicly known or made available prior to the time of disclosure to Mentor; (ii) becomes publicly known or made available after disclosure to Mentor through no wrongful action or inaction of Mentor; or (iii) is in the rightful possession of Mentor, without confidentiality obligations, at the time of disclosure as shown by Mentor’s then-contemporaneous written records. Mentee understands that information will be held as confidential unless otherwise agreed upon, in writing, except as required by law.
Client understands certain topics may be anonymously and hypothetically shared with other mentoring professionals for training or consultation purposes and Client agrees this is acceptable.
Client understands that mentoring is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual or other qualified professionals. I will seek independent professional guidance for legal, medical, financial, business, spiritual or other matters. I understand that all decisions in these areas are only mine and acknowledge and agree that my decisions and my actions regarding these matters are my sole responsibility.
The Company and Mentor shall have the right in perpetuity to use the Client’s name, image, and likeness in connection with credits, advertising and publicity for products for which the Client is participating, and during the Term otherwise in connection with the Mentor and its business.
GENERAL TERMS:
Termination. The parties acknowledge and agree that Mentor may, in its sole discretion, terminate all or part of this Agreement, including any outstanding sessions hereunder, by written notice to Client/Mentee not less than fifteen days (15) written notice of the termination with or without cause.
In the event of such a termination for cause, such as nonpayment or conduct detrimental to the team, etc., Mentor shall have no liability or further responsibility to Client. Once the mentoring sessions have expired, or the Client has been canceled or terminated, the Mentor-Mentee relationship has ended.
In the event of termination by either side, you'll receive a full credit toward a future Art Medicine Offering if you cancel at least four weeks before the retreat start date. If you cancel within four weeks of the retreat, you'll receive a 50% credit toward a future Art Medicine Offering. We do not offer cash refunds. We understand that life happens, and we want to offer flexibility while holding space for this special experience. Once the mentoring sessions have expired, or the Client has been canceled or terminated, the Mentor-Mentee relationship has ended.
Severability. If a court or other body of competent jurisdiction finds, or the parties mutually believe, any provision of this Agreement, or portion thereof, to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this Agreement will continue in full force and effect.
This Agreement shall be governed and construed in accordance with California law and/or law of the State in which the Mentor’s matter is being taken care of. If any provision in this Agreement is declared illegal or unenforceable, the provision will become void, leaving the remainder of this Agreement in full force and effect.
This Agreement and of Art Medicine constitutes the entire agreement and understanding between the parties with respect to the subject matter herein and supersedes all prior written and oral agreements, discussions, or representations between the parties.
By purchasing this Program with an installment plan, the Client hereby authorizes the Mentor to automatically charge the payment method provided for any ongoing installment payments owing as determined by the provisions of this Agreement.
Intellectual Property. You acknowledge and agree that we (or our licensors) own all legal rights, title and interest in and to the Service, including, without limitation, any intellectual property rights which subsist in the Service (whether those rights happen to be registered or not, and wherever in the world those rights may exist).
You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices) which may be affixed to or contained within the Service.
You agree that in using the Service, you will not use any trademark, service of Art Medicine, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.
Limited License. Subject to your compliance with this Agreement, you are granted a personal, revocable, worldwide, non-assignable, non-transferable and non-exclusive right to access and use the Service on a personal computer, browser, laptop, tablet, mobile phone, or other internet-enabled device (each, a "Device") and/or print one copy of the Content as it is displayed to you, in each case for your personal, non-commercial use only, in the manner and for the purposes expressly permitted by the Agreement and our associated policies. The foregoing limited license (i) does not give you any ownership of, or any other intellectual property interest in, any Content, and (ii) may be suspended or terminated for any reason, in Company's sole discretion, and without advance notice or liability. Your unauthorized use of the Content may violate copyright, trademark, privacy, publicity, communications, and other laws, and any such use may result in your personal liability, including potential criminal liability.
All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Art Medicine or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto. You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Art Medicine content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of Art Medicine and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Art Medicine or our licensors except as expressly authorized by these Terms.
RETREAT WAIVER & RELEASE

You hereby agree that by signing this document, I consent to waive certain legal rights, including the right to sue the Organizer named above, and, if applicable, its employees, owners, officers, directors, representatives, agents, volunteers and facilitators from any physical, material, tangible or intangible, loss or damages that may happen to me during my participation in the Retreat.
I will be voluntarily participating in the Retreat that will be conducted by the Organizer. The Retreat may include, but is not limited to, the "Retreat Activities" described above.
This Retreat Waiver will bind and be enforceable against me and all of my personal representatives. I agree that this Retreat Waiver should be enforceable to the fullest extent of the law, and if any portion is held invalid, the remainder should continue in full legal force and effect.
I specifically acknowledge and agree that this document is not intended to be a general release, which would be limited under some state and local laws.
This Retreat Waiver shall be construed and interpreted as broadly as possible in the applicable jurisdiction.
ASSUMPTION OF RISK. I understand and am aware that my participation in the Retreat involves risks. These risks may lead to tangible or intangible harm, and I agree that they may result not only from my own actions but also from the actions of others. With the knowledge and understanding of these risks, I choose, of my own will and volition, to participate in the Retreat.
I am also aware that there are risks that I may not have considered, yet I waive my right to any claims that may occur from these unconsidered risks and I choose, of my own will and volition, to participate in the Retreat.
COVENANT NOT TO SUE. I will not start any lawsuit or other court action against the Organizer, nor will I join any such proceeding, including any claim for money damages. I acknowledge and agree that I am entering a covenant not to sue the Organizer in any capacity, including to hold the Organizer liable for any injury, loss, or damage sustained by me or my property, even if it is due to the Organizer's negligence or omission. I also waive the right of any of my insurers' to make any such claim.
INDEMNIFICATION: I agree to defend and indemnify the Organizer and any of its affiliates (if applicable) and hold them harmless against any and all legal claims and demands, including reasonable attorney's fees, which may arise from or relate to my participation in the Retreat or my conduct or actions. I agree that the Organizer shall be able to select its own legal counsel and may participate in its own defense, if desired.
REPRESENTATION: I am over 18 (eighteen) years of age, and am emotionally, medically, and physically able to participate in the Retreat.
GOVERNING LAW: This Retreat Waiver shall be governed by and construed in accordance with the internal laws of California without giving effect to any choice or conflict of law provision or rule. Each party irrevocably submits to the exclusive jurisdiction and venue of the federal and state courts located in the following county in any legal suit, action, or proceeding arising out of or based upon this Retreat Waiver: San Diego County.
I have read the above Retreat Waiver fully and I understand and agree to its contents. I understand and agree that by signing this Retreat Waiver I forfeit any right, claim, or ability to hold the Organizer responsible for any tangible or intangible damages, loss of property, or loss of life that may occur during or after my use of the facilities and participation in the Retreat.
IN WITNESS WHEREOF, the duly authorized representatives of the Parties have caused this Agreement to be executed at the date and time of electronic purchase.
By consenting to this Agreement and purchasing the Certification, you are acknowledging that you have read, understood, agree to, and accept all the terms in this Agreement. Electronic signatures, and/or agreement to this Agreement by electronic check box, are sufficient and entirely enforceable.
